PLEASE READ THESE TERMS CAREFULLY BEFORE BUYING OUR TOURS. YOU ACKNOWLEDGE AND AGREE THAT BY ACCESSING OUR WEBSITE OR TICKING THE “I ACCEPT ALL TERMS AND CONDITIONS” BOX, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT ACCEPT THESE TERMS, YOU WILL NOT BE ABLE TO BOOK ANY OF OUR TOURS AND SHOULD NOT ATTEMPT TO USE THE WEBSITE.

The terms and conditions of purchase (“Terms and Conditions”) that are established herein constitute the framework of each contracting of Sevilla Tapas Tour experience, in their different modalities as well as other associated services as freely selected by you, which are made through our Website (“Tours”). The information herein must not be used for any other purpose.
These Terms and Conditions have been drafted in accordance with the current Spanish legislation, and in compliance with the Royal Decree 1/2007, of 16 November, which approves the revised text of the General Law for the Defense of Consumer and User and other complementary regulations.
- How to book a Sevilla Tapas Tour?
- For enjoying our Tours, you shall be required to follow the process on our Website and complete the relevant details we require to confirm purchase of your selected Tour through the Website (“Order”). Be informed that we may use a booking software and payment processor from a third-party provider which uses information security methods.
- During the Order process, you will be asked to provide customary billing information such as name, billing address, e-mail and credit/debit card information either to us or our payment processor.
- You agree to pay the Price of your Order by one of the methods described on the Website and you hereby authorize the collection of such amounts using the method selected by you through the Website, either directly by us or indirectly, via our payment processor or our booking software. If you are directed to our payment processor, you may be subject to terms and conditions governing use of their service. Please review such terms and conditions before using the processing services.
- Upon purchase of a Tour from our Website, you will receive the Order Confirmation by email along with your ticket and a booking reference number which constitutes your proof of purchase. Reception of the Order Confirmation is subject to the payment being correctly received by us or by our payment processor.
- Sevilla Tapas Tour for Groups
- Booking and purchasing of Tours of more than 8 people shall be treated as “Groups”.
- In case a User is interested in booking for a Group, User shall send a form through the “Contact Section” of our Website or via email to info@sevillatapastour.com.
- In case of availability of the requested date and if User is willing to complete the Order process, we will provide with a link to our Website for you to proceed with the completion of the Order and payment for the Group Tour.
- User may choose to (a) make a one-time payment in advance during the Order process or (b) request us to make a partial down payment equivalent to 50% of the total Price for the Tour during the Order process and the rest of the amount shall be paid seven (7) days before the Tour booked date.
- In case User selects the option (b) above, the reception of the email confirming the down payment and booking date DOES NOT CONSTITUTE AN ORDER CONFIRMATION, until the full payment is made in compliance with Section 4.4.
- We cannot guarantee the availability of the booked date, and we do not accept any liability towards the User if the Tour cannot take place on the booked date due to the User not paying the full Price for the Group Tour.
- Thereafter, and unless otherwise expressly established herein, all provisions described in these Terms and Conditions shall apply.
- Prices and promotional discounts
- The published price of each Tour is expressed in EUROS (“Price”) and includes any applicable taxes but is exclusive of the booking or collection fees. You shall be notified of the booking and/or collection fee on the payment page of the Website.
- If you have a promotional or discount code (“Code”), you may enter it on the relevant page of the Website prior to payment of your Tickets. We do not warrant or provide any guarantees that your Code will be accepted by the Website, since it would depend on the conditions of the promotional discount and specially, the duration period. If your Code is accepted by the Website, the Price will be adjusted accordingly. A Code will only be accepted at the time an Order (as defined below) is made and cannot be applied retrospectively.
- Due to the nature of the business, you acknowledge and agree that the Price may be subject to change and variation from time to time. Any changes in the Price shall not be applicable to you once you have received the Order Confirmation.
- Except as otherwise expressly provided in these Terms and Conditions, payment must be made in full at the time of purchasing a Tour, either by credit card, debit card or other means permitted from time to time. However, we do not accept cheques or cash.
- Order Confirmation delivery
- Order Confirmation will be supplied by email, within 24 hours of completion of the Order and subsequent payment to the e-mail address provided. The contract between us will only be formed following reception of the Order Confirmation (“Contract”). WE DO NOT ACCEPT LIABILITY NOR GUARANTEE THE AVAILABITY OF THE TOUR, IF PAYMENT IS NOT RECEIVED.
- It is your responsibility to check the accuracy and completeness of the details on your email of your Order Confirmation as we are under no obligation to rectify any mistakes once the Contract has been formed, in accordance with Section 6.1 above. Likewise, we take no responsibility should you not receive Order Confirmation due to reasons outside of our control e.g. junk or spam filtering.
- We will not be responsible for any Order Confirmation that is lost, stolen or destroyed. Order Confirmation is e-mailed to the address you supply to us at the time of placing an Order. You are responsible for ensuring your e-mail address is accurate. We are not responsible for Order Confirmation sent to incorrect e-mail addresses input by you.
- Order Confirmations are only for your personal use and that of your party. However, you are entitled to buy a Group Tour for the benefit of other if you properly notified us through the “Contact” section of this Website or through our email: info@sevillatapastour.com.
- Cancellations and refunds
- You are allowed to cancel your Tour and get a refund for the Price paid, if such cancellation is communicated with, at least, twenty four (24) hours prior to the scheduled start time of the Tour (according to the time zone of Spain mainland).
- Cancellations for Groups are also permitted if communicate with thirty (36) hours prior to the scheduled start time of the Tour (according to the time zone of Spain mainland); provided, however that we will charge a 30% cancellation fee of the total Price for the Group Tour.
- For a permitted cancellation, according to Sections 7.1 and 7.2 above, you must (i) contact us through the “Contact” section of this Website or by email to info@sevillatapastour.com; (ii) provide with the name of the person who made the reservation with the booking reference number; and (iii) send us along with the cancellation and refund request, the Order Confirmation.
- If conditions and requirements are fully met, we will proceed to refund the Price of the Tours (after deducting the cancellation fees in case of Groups) within the following fourteen (14) days from the date we confirm the cancellation meets refund conditions. Likewise, costs due to card or banking charges, currency exchange, or due to fees imposed by our payment processor or booking management will be borne by you and any amount to this respect, will be deducted from the refundable amount.
- Otherwise, if the requirements set forth in this Section 7.1 and 7.3 for ordinary Tours or Section 7.2 and 7.3 for Groups are not cumulatively met at the time of the request, you acknowledge and accept that you will lose the right to a refund.
- There will be no refund for lost or stolen Order Confirmations.
- What happens if Sevilla Tapas Tour cancels or modify a Tour?
- Sevilla Tapas Tour reserves the right to modify the day or cancel a Tour. However, if that occurs, we will promptly notify you at the e-mail address indicated during the Order process and propose either to accommodate a new date or the possibility of a full refund.
- If Users opts for a refund, User shall follow process set out in Section 7.3, and upon confirmation from us, refund will be made within the following fourteen (14 days). No cancellation fee will be applicable to Tour Groups when a Tour is modified or cancelled by us.
- It is you responsibility to ensure you have entered the correct contact e-mail address, so we can notify you. We will not be liable for any damages or losses you incur because of supplying us with the incorrect e-mail details and not being aware of the cancellation or modification.
- You will lose the right to a refund if cancellation is based on suspicious or facts of any resale, purported resale or attempted resale of Tours. This includes but is not limited to Order Confirmations or Tours being resold via internet auction sites. The holder of a resold Order Confirmation may be refused entry or rejected from the Tour without refund.
- Commencement of the Tour
- Before the Tour date, review carefully all information provided along with your Order Confirmation and the description of the Tour selected which is available in this Website.
- Minimum of one (1) guest required to proceed with scheduled Tours.
- We may request the ID identifying the name of the buyer of the Order Confirmation to be presented before the commencement of the Services at the schedule date for the Tour. We reserve the right not to carry out your Tour if the person in whose name the booking is made is not present for the Tour, unless during the Order process or afterwards the reception of the Order Confirmation, the person who booked for the Tour has properly informed us of the name of beneficiary/ies of the Tour.
- It is your responsibility to show valid Order Confirmation on your mobile or similar device or any other valid means. You may not be admitted to the Tour without presenting a valid Order Confirmation and you will not have right to a refund. We shall not be liable for any failure by you to show or proof existence of valid Order Confirmation.
- Except as otherwise agreed between User and us, you are responsible for arranging all transportation to the meeting point of the Tour which is indicated in our Website and in the Order Confirmation.
- How do we expect you to behave on a Tour?
- Our Tours may include admissions to third party venues, including restaurants and drinking venues (“Venues”). You must comply with all policies, procedures and safety announcements in force on the Tour and at any Venue, including any security procedures in place from time to time.
- It is your responsibility to notify Venues and your assigned guide of any allergies, intolerances, dietary requirements, health conditions, or special needs (related to mobility) that may affect the proper provision of the Tour prior to the Tour date. We shall not be held liable for any cross-contamination that may occur in the kitchens of the different Venues visited during the Tour.
- We shall not be liable for any loss or injury suffered by you caused by a Venue nor liable for any loss, damage or injury suffered by you in case of you have not communicated any of the foregoing circumstances.
- We reserve the right to refuse your admission without refund to any Tour or eject you from a Tour on account of your late arrival, being (or appearing to be) under legal age without being accompanied with at least, one of the parents or legal representative, abusive, threatening, drunken or other antisocial behavior (including smoking in no smoking areas), carrying offensive weapons or illegal substances, or making unauthorized audio, video or photographic recordings. In this case, Price will be non-refundable.
- Our Website offers Tours in Seville, Cádiz and Córdoba (Spain) and consequently, food and drink laws applicable in Spain will differ from your country of origin. It is your sole responsibility to ensure you comply with local laws when on Tours (e.g. legal age for alcohol consumption).
- We reserve the right to cancel the Tour or reject a person who is under legal age; provided that before the Tour date you have not informed us; and the minor is not accompanied by, at least, one of their parents or legal representative. Such parent or legal representative will remain responsible for persons under legal age. In case of non-compliance of all requirements in this paragraph, Price will be non-refundable.
- Data Protection

- Events outside our control
- We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under this Contract that is caused by an Event Outside our control.
- An “Event outside our control” means any act or event beyond our reasonable control, including without limitation strikes, lock-outs or other industrial action by third parties, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster, or failure of public or private telecommunications networks.
- If an Event outside our control takes place that affects the performance of our obligations to you:
- we will contact you as soon as reasonably possible to notify you; and
- our obligations to you will be suspended and we reserve the right to cancel any Tours affected by the Event outside our control.
- we will refund to you the Price for Tours cancelled by us because of an Event outside our control, in accordance with Section 7.4.
- Disclaimer
- We do not assume any liability whatsoever under the following circumstances:
- We are not liable under any circumstances to refund for the Price, when they have not complied with the cancellation process established in Section 7.
- If you are late to the Tour’s meeting point on the day of the activity. This means that we will not assume any responsibility if you are late for the activity and/or for not finding the correct meeting point.
- When your property is damaged or stolen during the Tour booked.
- If you suffer an accident, an injury or any type of damage during the Tour. Moreover, if you suffer an accident or injury before the Tour date that impedes you to assist to the Tour.
- For the weather conditions in which the Tour is carried out.
- To the fullest extent permitted by law, we are not responsible for any indirect damages, including but not limited to, special, exemplary, consequential, punitive damages, moral rights, reputation damages, loss of profits, data or goodwill loss or damage that is not foreseeable., loss of revenue, loss of production, loss of earnings, loss of contract, cost of capital, cost of purchased or replacement costs, loss of data, data corruption, in connection with these Terms and the Tour, whether or not the likelihood of such loss or damage was contemplated.
- We do not assume any liability whatsoever under the following circumstances:
- Modification and update of these Terms and Conditions
We have the right to revise and amend these Terms and Conditions from time to time, including but not limited to making changes to reflect current market conditions affecting our business, changes in technology, changes in payment methods and changes in relevant laws and regulatory requirements.
- Other terms
- Relationship between user and us. These Terms and Conditions are applicable to the User in relation to a Tour and no other person shall have the right to enforce them.
- Entire agreement. These Terms and Conditions and any document expressly referred to in them represent the entire agreement between you and us in respect of your use of the Website and the booking of Tours through this Website and shall supersede any prior agreement, understanding or arrangement between you and us, whether oral or in writing.
- Severability. Each of the clauses of these Terms operates separately. If any Courts or Tribunals or relevant authority decides that any of them are unlawful or null and void, the remaining clauses will remain in full force and effect.
- Applicable law. These Terms and Conditions are governed by Spanish law.
- Applicable jurisdiction. In the event of conflict or discrepancy in the interpretation or application of these Terms and Conditions, the Courts or Tribunals that hear the matter shall be those provided for in the applicable regulations on jurisdiction. It is further informed that, according to Law 1/2000, of 7 January, on Civil Procedure, the user may elect to file a claim on the courts corresponding to the user’s domicile or Sevilla’s Tapas Tour address.
